Tanzania: Island of peace or in pieces?

The first is the cowardly attempt on the life of the president of Tanzania Legal Society (TLS), MP for Singida East and Chama cha Demokrasia na Maendeleo (CHADEMA) chief legal counsel Tundu Lissu in Dodoma recently. It left Tanzania paralysed. Unknown people pumped over 20 ammos into Lissu who miraculously survived; and is still receiving medical treatments in Nairobi, Kenya. This bratty, brutal, horrific and terrific act is a gory scar on Tanzania. Up until now, nobody knows the motive[s] and motif[s] behind such barbaric and horrific attack.  It is too early to point fingers. Though, looking at the role Lissu has been playing in the country; the nature and style of the act, it is easy to link his attack with his vocalness. The Inspect General of Police (IGP) Simon Sirro and CHADEMA Chairperson, Freeman Mbowe, said that Sub-Machine Gun (SMG) was used on the broad daylight.  Before being shot, Lissu had previously complained to the authorities about being trailed by unknown people in car whose colour and number he reported to the authorities that took no action. Why? According to Mtama MP, Nape Nnauye, this car has been trailing other MPs.
            Now the Island Of Peace, Tanzania has been for longhas been put to the test.  We need to ask some spikey questions: How many Lissus must die for authorities to wake up from their slumber? Is Tanzania tired of tranquility and peaceability it has enjoyed for over 50 years? Those employing the art of killing detractors must remember: African countries whose rule is built on chaotic and shake foundations due to being or once being engrossed in violent conflicts started like this.
            To do away with bedlam resulting from the elimination of opponents, Tanzanians, especially the authorities, need to understand; this country belongs to all equally. Nobody is better than others. Quite so, nobody’s views or ideology are better than others. Nobody has the right to take away anybody’s right to expression, belief and life simply because of having opposing views.  True democracy is a magic bullet if not wand that can avert such nonsense and beastiality. Killing opponents is the solution for cowardly and skinny dictators.  If you kill one critic many will sprout right away. When Christopher Mtikila died, as an archcritic of the authorities, there came Lissu.
            They can kill Lissu and suchlike simply because they are uncontainable. Detain and torture them. You can’t detain their mouths or ideas.  Patrice Lumumba, Kwame Nkrumah, Thomas Sankara or Julius Nyerere, Nelson Mandela and Seletse Khama died. However, their ideas are still alive. Lissu too, can be killed; and dispose corporeally. Yet again, nobody can dispose or kill his ideal ideas.  By the way, is there any human being that’ll live forever?
            The second incident was the handing over of two reports to president John Magufuli on diamond and tanzanite that unearthed mega corruption in the mineral sector as a typical replica of what’s been going on for over a half decade almost in every venture the government has ever entered. To show his talons, Magufuli sanctioned the resignations of his two ministers, George Simbachawene (Minister of State in the President’s Office: Regional Administration and Local Government), Edwin Ngonyani, (Deputy Minister for Works, Transport and communication).
                        Implicated government officials were left to the Prevention and Combating of Corruption Bureau (PCCB) to deal with them. As for implicated politicians such as MPs, it seems the government doesn’t know what to do. Again, there is an answer to this; though from unexpected quarters. Handing over the reports, the speaker of national parliament Job Ndugai proposed that all parties whose members are implicated should be notified so that they replace them. He cited CUF’s example of nullifying the membership of some MPs whom it thereafter expelled and replaced. Implicated in the two reports were MPs Andrew Chenge and William Ngeleja (CCM). The duo has been mentioned previously in other reports but nothing was done to see to it that they face music. Chenge especially has been living in the ocean of scandals. In 2008, he was implicated by UK’s Serious Fraud Office (SFO) for having received $ 1 million as kickbacks in radar procurement. When he was asked about having such a humongous amount of money, Chenge replied that, to him, such was but peanuts. Therefrom, he was nicknamed mzee wa Vijisenti or Mr. Peanuts. Now that Chenge’s and Ngeleja’s dirty laundries are in the agora, will CCM follow suit and heed Ndugai’s call? However, president Magufuli pre-empted what can happen to the culprits saying that, the CCM has its way of dealing with them among which is being reprimanded. Many wondered why Magufuli who is CCM’s chairman fell short of saying that the culprits can be expelled from the party based on what he calls party’s code of conducts.
            In sum, thanks to what transpired, is Tanzania going to the dogs? Is the island of peace in pieces?

Zetu ni Uhamiaji au uhamishaji, biashara au bi hasara?

      Image result for photos of wachina morogoro      Taarifa kuwa kuna wachina walikamatwa wakiendesha kiwanda bila kibali nchini kwa tangu mwaka 2010 huko Morogoro ni za kuchefua na kuchukiza. Sikujua kuwa nchi yetu itafikia hapa kiasi cha kuibiwa kana kwamba ni nchi ya mataahira au marehemu kiakili. Tokana na kadhia hii, kuna maswali tunayopaswa kujiuliza kama taifa na watu wenye akili mojawapo yakiwa: Je uhamiaji hakikuwa na taarifa au walikatiwa kitu? Je kuna wachimbaji wa kigeni wangapi nchini? Je mchezo huu ulianza lini?  Pia visa vya wachina kukamatwa ima wakichimba madini au kufanya kazi na kuishi bila vibali au kutorosha nyara za umma na madini vimezidi nchini. Sijui wako wahindi, wapakistani, waturuki, wanigeria na wengine wangapi wanaofanya mambo kama haya nchini wakati wananchi wetu wakishuhudia au kuripoti mamlaka zisichukue hatua?

            Ukiachia mbali uhamiaji, ilikuwaje wizara ya madini haikujua au nao wana ushirika katika kuliibia taifa kwa kufumbia macho wezi kama hawa ili mradi wanapata chao?  Japo ni mapema kutoa lawama, kuna uwezekano huu ni mchezo wa baadhi ya maafisa wa juu nchini. Maaana, hakuna kilichonishangaza kama kusikia kuwa wachina hao waliokutwa wakihujumu nchi walikuwa wapelekwe Dar es Salaam ili warudishwe kwao. Warudishwe kwao wakasherehekee kuwaibia mataahira siyo? Kwanini warejeshwe kwao wakati wanakabiliwa na mashitaka lukuki yakiwemo ya kuhujumu uchumi na kutishia usalama wa taifa kwa kuingia na kuishi na kufanya kazi kinyemela? Je hawa wanaotaka kuwarejesha kwao kweli hawajui sheria au kuna kitu wanataka kuficha. Haiwezekani mtu avunje sheria ya nchi hata kama ni mgeni aondolewe nchini bila kuhukumiwa na mahakama nchi ikawa salama.  Hata mhalifu kama huyu akikamatwa na chizi, achia mbali mtu mwenye akili timamu, atamsulubu. Hata akikamatwa na mbwa, hataaacha lau kumng’ata kwa kujua na kutambu aanavyomhujumu. La msingi, mafisadi na wasaliti wanaokula na wahalifu hawa, ni kujua kuwa wakati wakiwaachia wachina hawa au wahalifu wa mataifa mengine, kuna vijana wengi wa kitanzania wanaozea kwenye magereza ya nchi mbali mbali hasa China wakingoja kunyongwa kwa kupatikana na hatia za kusafirisha madawa ya kulevya. Hawa nao ni watafutaji sawa na hawa wachina hata kama wanafanya uhalifu tofauti. Nadhani hapa tofauti yao ni kwamba hawa wanauza unga na hawa wanaiba raslimali za nchi. Hivi watanzania tulirogwa na nani na kuwa na roho mbaya hivi itokanayo na ujinga, upogo, ulafi na ubinafsi? Tunachezea raslimali zetu kana kwamba tutaishi milele. Hivi mababu zetu wangekuwa wapumbavu hivi tungekuta nini zaidi ya mashimo na mabwana wa kutugeuza watumwa?  Mamlaka zinazohusika na kupambana na rusha na ufisadi, zifuatilie kisa hiki zinaweza kugundua vingi na mengi hasa wakati huu ambapo jinai ya kushirikiana na wageni kuibia taifa inazidi kuwa kidonda ndugu.
            Mbali na wizara ya madini, ilikuwaje wizara ya biashara na viwanda nayo haikufahamu kama hakuna mchezo mchafu hapa?  Maana, ushahidi kuwa kuna mchezo mchafu, ni maneno ya Afisa mmoja wa madini aliyelalamika kuwa aliwahi kushughulikia sakata hili akasimamishwa kazi. Je wako wezi kama hawa wangapi nchini na wameishaliingizia taifa hasara kiasi gani? Je wapo watendaji wangapi wa serikali wako nyuma ya hujuma hii na kwa muda gani? Haiingii akilini eti kwa nchi yenye vyombo vyote vya usalama isiwe na taarifa za watu tena kutoka mbali kama China wenye rangi tofauti kwa miaka yote hii. Kama ni hivi basi Tanzania ni nchi ya ajabu na usalama wake uko hatarini.
            Pamoja na kwamba kwa sasa China inaonekana kama mwekezaji mkubwa nchini, tunapaswa kuwa makini. Kwani haina tofauti na nchi za magharibi zilizotutawala na kutunyonya kwa muda mrefu kabla ya mababu zetu kujitoa mhanga kupigania uhuru. Tofauti na nchi za magharibi zilizokuwa zikituma vikundi vichache vya mawakala wao kama vile wamisionari, wafanyabiashara, wavumbuzi na watawala, wachina wanatutumia watu wao wasio na ajira kuja kuchukua ajira za watu wetu ukiachia mbali kujiingiza kwenye shughuli za jinai baada ya kubaini kuwa baadhi ya watendaji wetu ni walafi na wapumbavu wasio na mapenzi na taifa lao. Huu upuuzi unaoripotiwa kila siku huwezi kuutenda China ukaachiwa uende kwenu. Watakupiga risasi. Ni bahati mbaya kuwa kosa la kuhujumu uchumi au ufisadi nchini linafanyiwa mchezo tokana na kuhusisha wakubwa wengi. Kule China wanapiga risasi bila kujali wewe ni rais, raia au mgeni.
            Tumalizie kwa kuzitaka mamlaka kuchunguza aina hii ya ufisadi na uhujumu kwa taifa. Pia tunashauri zitungwe sheria kali za kupambana na wezi hawa pamoja na washitili wao. Mbali na hilo, kuna haja ya kuelimisha wananchi wetu kuwa macho na mali zao. Maana hazitaishi milele. Pia haina sababu wao waendelee kuishi kwenye umaskini wa kunuka wakati wageni wanakuja na kujichotea watakavyo.

Kijiwe chafunga kumuombea Lissu

Wigs, robes a carryover of colonial courts

             The fact of the matter is, European colonizers intended to abuse, alter and demonise Africans’ identity and symbols by imposing white wigs so that we could look the way they wanted us to look like but not who we actually are.

            So, too, colonialists wanted—and of course, succeeded—to kill our self-assurance and amour-propre (self-respect).

        Again, although wigs have their roots in ancient Egypt, did African judiciaries choose them based on gen and understanding?

                                                                  RACISM
Whatever motif and motive behind the wigs in colonial courts, they can’t serve the same purpose in free countries such as ours—well, if, indeed, they are free and want to be free.

         Mani Cavalieri, a database analyst, said Whites depicted and viewed black people “as being literally sub-human, mentally retarded, cowardly, incompetent, and often crazed” who can’t invent anything. Dr Mutunga deconstructed such archaic predisposition.

COLONIALISM
Sadly, some of the changes Dr. Mutunga introduced and implemented are being clear-felled pointlessly.

            During the hearing of the recent presidential petition, I bewilderingly and melancholically saw some ‘learned friends’ in wigs and robes.

Honestly, I wonder when I see a lawyer in the hot streets of Dar es Salaam or Mombasa torturing himself in suits simply because it is the “dress code”.

            This means there are some colonial carryovers that our institutions and personnel have refused to shed.

                                                                       JUSTICE
I don’t get it when I hear such people aggrandizing themselves by referring to one another as ‘learned friend’ yet they still wear wigs and use bombastic and loaded incomprehensible words instead of plain and simple language.

            Back to Dr Mutunga. He wanted Kenya’s Judiciary to look more Kenyan than British. He wanted to take the Judiciary to the people who are made to believe that it is ex-debito jusiticiae, the fountain of justice.

            But how can a wigged or masked Judiciary be while it fails to do justice by respecting the identity of those it serves—as it is the case in donning wigs and gloves for some of our public personnel?

                                                                      IMPRESSION
            In Wigs, Skeletons, Bibs, Bands, and Bundles: An Albertan Barrister Deciphers the English Court of Appeal (Criminal Division), Laura Hoyano writes that “wigs are supposed to confer dignity, but I think that they make the wearers resemble sheep, and I find it difficult to keep a sober countenance, especially when ‘full bottom’”.

            The Judiciary should rethink about abandoning the changes Dr. Mutunga chaperoned for the deconstruction and emancipation of the Kenyan Judiciary from its colonial past.

                                                       NATIONAL PRIDE

            But then, how many Kenyans understood the philosophy and wisdom of Dr. Mutunga? Latin has it that no one is considered a prophet in his homeland.

           And, I believe, Dr. Mutunga was a prophet of change.

            Importantly, he did it not for personal but national gain and pride.

Barua ya wazi kwa maaskofu Kilaini na Nzigilwa

Ni pale mlipotuhumiwa, kabla ya kukiri, kuchotewa fedha zilizotokana na kashfa ya wizi wa fedha za umma wa watanzania maskini ijulikanayo kama Escrow mlizopewa na mtuhumiwa na muasisi mkuu wa kashfa hii, James Rugemalira ambaye sasa yuko korokoroni akituhumiwa kwa makosa ya kulihujumu taifa na kuuibia umma. Hivyo, sitaweza kuingi undani wa suala zima tokana na sababu za kisheria na ukweli kuwa mnalijua vizuri hata kuliko mimi kama wanufaika ambao sasa wanajitenga na mshitili wao.
            Hivi karibuni, nilisoma tangazo lenu la tarehe 7 Septemba, 2017 kuutaarifu umma kuwa mmeamua kurejesha zile fedha kwa serikali baada ya kujiridhisha kuwa hazikupatikana kihalali. Je mmetubia dhambi hii itokanayo na uroho ambayo ni kinyume cha mafundisho ya Yesu Kristo? Je mmetumia vigezo gani hasa ikizingatiwa kuwa atoaye sadaka kanisani au matoleo, kama manavyoita, huwa haulizwi namna alivyochuma fedha atoazo? Maana ingekuwa hivyo, bila shaka mngelimuuliza Rugemalira alivytengeneza hiyo fedha kabla ya kuzichukua na kuishia kwenye kashfa ambao itawagharimu vilivyo kama mkondo wa sheria utafuata ikizingatiwa nyinyi ni viongozi na watumishi wa umma waliopokea fedha chafu zitokanazo na wizi wa fedha za umma. Je huu si ushahidi tosha kuwa hii fedha haikuwa ya kanisa bali yenu kutokana na kitendo mlichofanya mkidhani kitawasafisha kikaishia kuwafichua na kuwachafua zaidi?  Katika tangazo tajwa hapo juu, mnakiri kupokea fedha ambazo hamkutaja ni kiasi gani ingawa inafahamika ni shiling milioni 40 na ushei, hapo Februari 2014 kupitia kwenye akaunti zenu za benki.  Hii maana yake ni kwamba fedha tajwa ilikuwa benki kwa takriban miaka mitatu ikitengeneza faida. Je mmerejesha na interests zilizolipwa na benki tokana na kuwa na kiasi hiki kikubwa? Je tukiacha ubabaishaji na kujitetea, kweli kwenye nafsi zenu hamkujua kuwa fedha hii ilikuwa kubwa; na uwezekano wa mhusika kuipata visivyo halali ulikuwa mkubwa ikizingatiwa kuwa kashfa yake haikuanza jana wala juzi? Je mnategemea kufanikisha nini katika hatua hii ambayo kisheria ni ushahidi wa wazi unaoweza kutumika dhidi yenu? Je kwanini mlingoja mpaka Rugemalira akamatwe? Je angeendelea kunyamaziwa mngechukua hatua mlizochukua au ni baada ya kugundua kuwa mambo sasa si mchezo wala mazoea kama ilivyokuwa imezoeleka nchini ambapo mafisadi wakubwa walizoea kulindwa na kuengwaengwa huku wakiwakoga wale waliowaibia? Kuna haja ya kutubu na kujisuta sana huku mkisema ukweli ili mueleweke na ikibidi kusamehewa au kuhukumiwa kulingana na wenye fedha watakavyoamua.
            Wapendwa, naomba niendelee kuwadodosa lau ukweli ujulikane ili uwaweke huru.  Katika tangazo lenu mlidai kuwa fedha husika ilikuwa ni matoleo.Je kama kweli yalikuwa ni matoleo, kwanini yaliingizwa kwenye akaunti zenu na si kwenye akaunti za makanisa yenu? Hapa nani anasema ukweli; na utaratibu wa kupokea matoleo ni upi kwa mujibu wa kanuni za kanisa? Je kwanini mmeamua kurejesha fedha serikalini na si kwa yule aliyewapa au familia yake wakati mkijua serikali aihusiki kwenye kashfa hii? Je mlipata ushauri wa kisheria ua wa kidini katika kufikia hatua hii hatari. Kwani, kiushahidi wa mazingira, hamna tofauti na wanufaika wengine waliohongwa tokana na nafasi zao katika utumishi wa umma ambao nanyi, kama watumishi wa kiroho, mnahusika? Je kitendo chenu cha kupokea fedha chafu kwenye akaunti binafsi kinatoa funzo na picha gani kwa jamii yetu? Je mnadhani mlichofanya ni suluhu ya sakati hili linalopaswa kuisha kisheria?
            Wapendwa, japo sitaki niseme mengi wala kuhukumu ili nisihukumiwe, tangazo lenu limeficha mengi zaidi ya liliyoweka wazi. Kwa mfano, kwanini hamkueleza utaratibu unaojulikana kikanisa wa muumini kutoa matoleo kwa kanisa ili umma upime kama kilichofanyika ni sawa au si sawa? Je kwanini mmechukua muda mrefu kufikia uamuzi mliofikia? Lazima kuwe na sababu zaidi ya mhusika kuwa korokoroni. Je mlifanya jitihada za kumrejeshea aliyewapa hiyo fedha kabla ya kufikia kuzipeleka serikali au mnafanya hivyo, ili serikali na umma usiwashughulikie?
            Nimalizie kwa kusema kuwa kitendo chenu kinaacha maswali mengi kuliko majibu. Sidhani kama serikali itaona sincerity kwenye kitendo hiki zaidi ya kuwa mbinu ya kutaka kuepukana na matokeo ya kashfa hii ambayo ni kufikishwa mbele ya vyombo vya dola ili haki itendeke. Maana, hali tuliyo nayo nchini kwenye ufisadi inatisha na kukatisha tamaa ingawa rais anajitahidi kupunguza madhara na ukubwa wa tatizo ambalo watangulizi wake walililea na kulifumbia macho. Si viongozi wa serikali wala wa kiroho japo si wote, imewaozesha na kuwaharibu kiasi cha kusahau hadhi, heshima na wajibu wao kwa umma. Ushauri wangu wa bure kwenu ni kwamba kirini kukwa mlipotoka na muombe msamaha mambo yaishe ili liwe somo kwa wengine wanaodhani kuwa wanaweza kutumia nyadhifa zao kula na mafisadi.

Mlevi ataka Katiba Mpya kama Kenya

            Baada ya mwana wa mfalme U-freedom Kinyataa kunyang’anywa ulaji wa dezo unaosemekana kupatikana kiharamu kwa njia ya uchakachuaji ambao sasa umegeuka fasheni Afrika, ilibidi nisukuti. Tokana na kusukuti huku, leo sitaki longolongo wala mizungusho bali kusema kwa kinywa kipana tena kwa herufi kubwa kuwa kaya yetu inahitaji katiba mpya ili kufanya mambo kisasa na si kizamani kama ilivyo na ilivyozoeleka. Hebu msomaji tuseme pamoja kwa herufi kubwa “TUNATAKA KATIBA MPYA ILI TUFANYE MAMBO MAPYA”
            Naona yule anagwaya akidhani yatamkuta yanayowakuta akina Tunduni Liisu. Ogopa Mungu si miunguwatu. Wanaweza kufunga mwili wako lakini  si mdomo wako wala mawazo yako. Kwani kaya hii ni yao au mama zao? Hebu tusema pamoja “TUNATAKA KATIBA MPYA SASA VINGINEVYO HAPAKALIKI HAPA.”
            Japo inaweza kuonekana kuwa najipa ujiko na kujifagilia, ni kwamba mawazo yangu yamechangia kufikia hapa ninapoongelea. Naona yule anatikisa kichwa na kusonya. Kama unadhani hizi ni kamba au longolongo asome gazeti la Kenya linaloheshimika la Daily Nondo utakuta nondo na vimondo vyangu. Kwa wasiojua hawa jamaa wanavyopendana kiasi cha kutotaka wageni waingilie mambo yao, kupata fursa ya kutupa mawe mle si kawaida. Lazima kichwa kiwe kinajibu na kuchemka kweli kweli. Nadhani mimi ni mlevi pekee toka Bongo aliyepata fursa ya kutupa mawe mle si mara moja wala mbili. Naona yule anazidi kubeua midomo na kutikisa kichwa. Maskini hajui kuwa nabii hakubaliki nyumbani yaani kwa kilatini Nemo profita in patria sua. Hayo tuyaache.
            Kuna maswali ya kujiuliza. Je ilikuwaje mwana wa mfalme akanyang’anywa tonge mdomoni wakati alikuwa na kila zana za kuchakachua? Si baada ya kustukia mchezo wa uchakachuaji, mpinzani wake Jadwong Madwong amaye by extension ni rafiki yangu na dingi, akaenda kwa Pilato. Kwa vile Katiba ya kule inaruhusu kila mlevi kwenda kwa Pilato anapohisi hajatendewa haki si Pilato akampa alichotaka kwa kumpiga chini mwana wa mfalme. Just imagine. Unadhani ingekuwa Bongolala na katiba yetu viraka jamaa angetoboa kama wasemavyo huko? Wala kisingeumana.
            Kwa vile nimependa chesi hii, nawaalika walevi wote wapenda demokrasia bila ghasia na maendeleo vya kweli waje tupange namna ya kuwabana wanene wetu warejeshe Katiba yetu mpya ya jaji Jose Waryuba iliyouawa na majambazi na mafisadi ili wasinyee debe kama akina Singasinga na Rugetumbuliwa bila kumsahau jamaa yangu Manjilinji. Au vipi walevi? Semeni kwa pamoja ‘Tumechoka na longolongo, ubabaishaji na mauaji ya Katiba mpya ya kaya.” Sema tena “Tunataka Katiba mpya na si uongo mpya.”
            Ninapoandika hapa, dingi atakuwa akitabasamu kwa swahiba yake kupata fursa nyingine ya kujaribu urahisi huku ndugu yangu Eddie aliyeshabikia upande wa pili akiugulia kwa machungu ya hukumu hii takatifu.
            Tukirejea umuhimu na majaliwa ya Katiba mpya, lazima niseme bila kumung’unya kuwa huwezi kuendeleza kaya bila kuwa na haki na uhuru kwa wanakaya kama ilivyo sasa. Hivyo basi, wote wanoota ndoto za nchana kuwa kaya inaweza kuendelea kwa maigizo wanapoteza muda. Maana, Katiba mpya ndiyo muarobaini wa ufisadi, uvivu na ubabaishaji ambavyo dingi amejaribu kutumbua akaishia kuchoka kabla hata hajamaliza ngwe moja. Hata hivyo, amejitahidi. Sema angekuw anashaurika, hakuna jambo la maana angewatendea walevi kama kufufua nchakato wa Katiba mpya ili itumike kuleta usawa, haki na uwajibikaji kayani kama ilivyotokea kwa majirani zetu wa the country of man eat man hivi karibuni.
            Huwezi kuendeleza kaya wakati kuna matabaka ya walevi ambapo wapo wasioguswa na wanaotolewa kafara kwa sababu wanaeleza mawazo yao ambayo ni haki yao kikatiba. Presidential rerun; Kenya isn’t out of the wood yet

          No doubt. Kenya is facing a Solomonic test that begs for Solomonic wisdom. After the Supreme Court of Kenya nullified president Uhuru Kenyatta’s win, Kenya, once again, was pushed back to square one as far as the search for its president is concerned. September 1, 2017 goes to the annals of history as the day, for the first time in East Africa, Africa and the world at large, president’s results were nullified. What a big blow for rulers in countries in the region who tamper with the constitution to cling unto power.! For, from what transpired in Kenya, many citizens have seen the beauty of having progressive constitutions. This means; Kenya is now shifting gears from presidential democracy to Constitutional democracy. Notably, up till now, the full ruling and the rationale thereof have not been known. For, the court hasn’t yet released them.
            However, the Supreme Court, in its decision, ruled that Kenya’s presidential election was not credible, free, fairs and verifiable; thus invalid, null and void thanks to the illegalities and irregularities the court found. The said election didn’t meet constitutional prescriptions as stipulated in Kenya’s constitution. Therefore, the Court ordered the rerun within 60 days of make or break that will decide the future of Kenya.  With Kenya’s future hanging in the balance, as country and a people, needs more than what it takes to come out of this imbroglio peacefully and safely. There are a few reasons to think that anything can happen though elections and a long waiting that followed were peaceful and hopeful.
            First, I don’t think; the time stipulated in the constitution is sufficient enough for Kenya to conduct credible, free and fair presidential election. Apart from the constraints of time, there are resources constraints such as finance, logistic, procurement of electoral materials and whatnots.
            Secondly, the body charged with conducting the election, the Independent Electoral and Boundaries Commission (IEBC), like the court, is now at the receiving end, especially from the losers of the petition. Recently, president Kenyatta and his deputy slung mud at the judiciary while the opposition, the National Super Alliance (NASA) said categorically that the IEBC has lost its credibility, thus, it cannot conduct another election. While the NASA wants the IEBC to pack And hit the road, the status quo prefers it to conduct the rerun as prescribed in the constitution. This means: Kenya is facing legal-cum-political impasse at the same time. The situation becomes even dire due to the fact that the constitution stipulates that elections should be conducted in 60 days shall the results be nullified.  Legally speaking, such provisions were enacted to deal with parliamentary; and possibly gubernatorial and other disputes but not presidential. This is why the Supreme Court’s ruling caught Kenya off guard. Never had in Africa any presidential victory been quashed. Thus, those who enacted the law didn’t expect such an eventuality would happen. Is Kenya capable of conducting a credible, free and fair election within the confines of the constitution? How if  the NASA doesn’t trust the IEBC? Will wisdom dictate that Kenya amends its constitution to accommodate this eventuality?
            Third, apart from legal limbo and political imbroglio-cum-quandary, recently the situation took a bad turn when President Kenyatta and his deputy, William Ruto, attacked the decision; and referred to the Supreme Court as Kangaroo  court and judges wakora or crooks which is unfortunate and bad. Ironically, the same said that they will respect its decision!
            Fourth, looking at how diverging and discordant the campaigns and polls were, Kenya is currently divided right down the middle gyrating around ethno-affiliations. This shifts national politics to ethnopolitics whose tendencies are always deadly and unpredictable if we remember the 2007-2008 Post-Election Violence (PEV). I am not trying to be a doomsayer or a worrywart,. chiefly when I explore the fact that the protagonists who caused such a crisis are almost the same save that this time the competition is between Kenyatta and Raila Odinga as opposed to Mwai Kibaki and Odinga. Importantly, the duo comes from the same antagonistic tribes and their alliances.
            Now what should be done to do away with this catch-22?
            Firstly, the Supreme Court should caution politicians about the contempt of court. Shall they stand their ground; they must be sued and punished. This will de-escalate the looming danger such monkey business can cause.
            Secondly, the NASA must go to court to stop the IEBC from conducting the rerun. For, it was found liable for some criminal negligence; and partly the contempt of court due to refusing to allow the petitioners to access some evidence as ordered by the court.
            To cut a long story short, Kenya needs Solomonic wisdom to pull it out of the limbo is in. and this is only possible shall all Kenyans stand as one as they shy away from their tribal bubbles.
